"Unpublished works in archives are protected by U.S. copyright law, and authors maintain exclusive rights to control the duplication and distribution of their work. Although authors may transfer their copyright ownership to others or give a library ownership of the work itself, even if it is the only existing copy, this does not by itself transfer copyright in the work. The doctrine of fair use allows the copying of copyrighted works in limited situations. While not every educational use is considered fair use, copying or quoting small amounts of copyrighted material, particularly for the purpose of historical research or criticism, may be considered fair use." https://legalbeagle.com/6606003-anime-copyright-laws.html

Biographical / Historical

This collection contains documentation from four separate lawsuits, initiating from an illegal eviction of farm workers Salvador Ferreira, Alfonso Villegas, Mr. and Mrs. Valdoza, and Geraldo Sanchez, all living in Oxnard, CA in the same housing area owned by HR Incorporated. The landlord, Larry Rodarte of HR Incorporated, facing complaints and notices to refurbish/clean-up/fix by the City, did not satisfactorily remedy the issues and evicted his tenants, without following the proper legal procedures of a three-day notice. The question was whether Mr. Rodarte evicted his tenants in retaliation because they brought habitability complaints to him. This collection (boxes 17-22) consists of some of the documentation regarding the unlawful detainer that Larry Rodarte brought in municipal court against Mr. Villegas and others (HR, Inc. v. Villegos, et al, case no: 168144). The defendants were successful in presenting their case. The plaintiffs then filed a habitability cause of action against Mr. Rodarte and were ultimately successful in their claim. The early facts of this legal action are detailed in the various depositions and other documentation concerning the case of Ferreira v. HR Inc., case number: 173472, boxes 12-16. The last case to be filed, Ferreira v. HR Inc., case number: 189382, introduced another defendant, Frans De Witte, a business associate of Larry Rodarte and HR Inc., who became a Trustee of HR. Included in this collection are depositions and other discovery and correspondence in boxes 1-11. The plaintiffs were ultimately successful in their fraudulent property transfer claims (from Rodarte to De Witte as trustee).
